BIG TRAIL CUSCO – TERMS & CONDITIONS

(Motorcycle Rentals & Motorcycle Tours)

Once you have chosen a program or rental service, please carefully read the following Terms & Conditions. Any payment made to BIG TRAIL CUSCO constitutes full acceptance of these terms and is binding for all participants.

1. General Conditions

Programs, routes, or schedules may be modified due to weather, road conditions, mechanical issues, safety considerations, or group needs.
BIG TRAIL CUSCO is not responsible for loss, theft, or damage of personal belongings.
BIG TRAIL CUSCO assumes no responsibility for illness, injury, accident, or death. All related costs are the sole responsibility of the client.
The client is fully responsible for any motorcycle, equipment, or accessories provided. Any loss or damage must be fully compensated.
The client declares to be physically and mentally fit to ride a motorcycle.

2. Motorcycle Rental – Deposit & Reservation

To confirm a motorcycle rental, a 50% deposit of the total rental cost is required.
This deposit secures the motorcycle exclusively for the reserved dates.
The deposit is applied toward the total rental cost.
All bank fees or transfer costs are the responsibility of the client.

3. Motorcycle Rental – Cancellation Policy

All cancellations must be notified in writing.
No refunds are issued for early returns, unused rental days, or partial cancellations.
Refunds (when applicable) exclude transaction, transfer, or bank fees.
BIG TRAIL CUSCO reserves the right to retain the full deposit if the client fails to meet rental requirements (valid driver’s license, passport, security deposit, or riding ability).

4. Motorcycle Tours – Booking & Payments

A 50% non-refundable deposit is required to confirm any guided motorcycle tour.
The remaining balance must be paid at least 24 hours before departure.
Prices are quoted in U.S. Dollars (USD) and will not change once confirmed.
Accepted payments: cash (USD or Peruvian Soles) and Visa credit card (8% commission applies).

5. Motorcycle Tours – Cancellation Policy

The tour deposit is non-refundable under any circumstances.
If the full tour amount has been paid:
- More than 15 days before departure: only the amount paid above the deposit may be refunded.
- Less than 15 days before departure or no-show: no refund.
We strongly recommend travel insurance to cover cancellations.

6. Changes or Cancellation by BIG TRAIL CUSCO

Events beyond our control include weather conditions, mechanical failures, social unrest, strikes, government decisions, or force majeure.
In such cases, BIG TRAIL CUSCO will offer alternative or comparable arrangements, but no refunds.
If BIG TRAIL CUSCO cancels a service for internal reasons, 100% of payments made will be refunded.
BIG TRAIL CUSCO is not responsible for additional expenses incurred by the client (flights, visas, accommodations, vaccinations, etc.).

7. Acceptance of Risk

Motorcycle riding involves inherent risks, including injury, permanent disability, death, or damage to property. The client voluntarily assumes all risks and releases BIG TRAIL CUSCO from any liability arising from participation in rentals or tours.

8. Authority During the Tour

The guide or company representative has full authority regarding safety decisions.
Failure to comply with instructions, Peruvian laws, or drug regulations may result in immediate removal from the service without refund.

9. Travel Documents & Requirements

A valid passport is required (original or copy).
A valid motorcycle driver’s license and security deposit may be required for rentals.

10. Travel Insurance

Comprehensive travel insurance covering motorcycle riding, medical expenses, emergency evacuation, repatriation, cancellations, and loss of belongings is strongly recommended.

11. Third-Party Services

BIG TRAIL CUSCO may work with independent suppliers and is not liable for their acts, omissions, delays, or failures.

12. Claims & Jurisdiction

Complaints must be reported immediately and submitted in writing within 7 days after the service.
Liability is limited to the amount paid.
All disputes are governed by Peruvian law, with exclusive jurisdiction in Cusco, Peru.
